INFORMATION on the processing of personal data as per Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council.


1. Foreword

By Art. 13 of Regulation (EU) 2016/679, the Government of Emilia-Romagna Region (Giunta della Regione Emilia-Romagna), as “Controller”, must provide the data subject with all the information on the processing of personal data. .


2. Identity and contact details of the Controller

The Controller of personal data is the Government of Emilia-Romagna Region (Giunta della Regione Emilia-Romagna), whose premises are in Bologna, Viale Aldo Moro n. 52, postal code 40127.

In order to simplify the process of sending and reducing the response time, we invite you to address all the requests concerning par. 10, to: “Regione Emilia-Romagna, Ufficio per le relazioni con il pubblico (URP)”, in writing or by going personally to the URP counter.

3. Data Protection Officer

The Data Protection Officer appointed by Emilia-Romagna Region is reachable via email at dpo@regione.emilia-romagna.it or at the premises of Emilia-Romagna Region in Viale Aldo Moro n. 30, Bologna (Italy).


4. Processors

Emilia-Romagna Region can use third parties to perform its tasks and the related personal data processing, of which it remains the Controller. In accordance with the legislation, such third parties ensure a sufficient level of experience, capacity and reliability necessary to guarantee the full respect of the obligations laid down in the legislation, including the data security profile.

Emilia-Romagna Region formalizes the instructions, tasks and responsibilities of the third parties by designing the same parties as “Processors”. Emilia-Romagna Region performs periodic audits and inspections on the subjects designated as Processors, with the aim of assessing the adherence to the requested level of guarantee set out in the original contract or legal act of designation.


5. Authorized persons within the Controller

Your personal data are processed by employees of Emilia-Romagna Region previously authorized and designed as Processors, with specific instructions on the technical and organizational measures required by the Regulation (EU) 2016/679 in order to safeguard the rights and freedoms of the data subject and the protection of personal data.


6. Purposes and legitimation of the processing

The processing of your personal data is carried out by the Government of Emilia-Romagna Region (Giunta della Regione Emilia-Romagna) in the performance of its institutional tasks and, therefore, in accordance with Art. 6 comma 1 point e), the consent by the data subject does not apply. Personal data are processed for the following purposes:


  1. to create the user account within the Geoportal of Adriatic-Ionian Region (hereinafter GAIR), at: https://www.portodimare.eu/
  2. to manage and update your user account;
  3. to associate the user account to a policy group (upon request of the user);
  4. to expose the metadata associated to the dataset uploaded in the GAIR by the user.


7. Recipients

Your personal data can be disclosed and/or transferred to another Institution or subject only if and when the GAIR hosting is transferred to an Institution or subject, other than Emilia-Romagna Region, among those who are part of the transnational network supporting the GAIR, including those based outside the European Union.

In this case, the data subject will be previously informed about the transferring and the disclosure by Emilia-Romagna Region. In any case, being the product of a project co-funded by an Interreg Programme, the GAIR remains ruled according to the legislation of the European Union, regardless the hosting Country.


8. Transferring of personal data to Third Countries outside the Union

Your personal data can be disclosed and/or transferred to another Institution or subject only if and when the GAIR hosting is transferred to an Institution or subject, other than Emilia-Romagna Region, among those who are part of the transnational network supporting the GAIR, including those based outside the European Union.

In this case, the data subject will be previously informed about the transferring and the disclosure by Emilia-Romagna Region.

In any case, being the product of a project co-funded by an Interreg Programme, the GAIR remains ruled according to the legislation of the European Union, regardless the hosting Country.


9.Period for which the personal data will be stored

Your personal data are stored for a period that is no longer than what is necessary to fulfil the purposes laid down in paragraph 6.

To this end, the Controller constantly verifies by means of periodic controls that data collected are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed (data minimization), also in relation to the personal data that you provide on a voluntary basis.

Personal data that result from the controls to be inaccurate, exceeding or not necessary having regard to the purposes for which they are processed, are erased or rectified without delay and the data subject is informed accordingly.


10. Rights of the data subject

As data subject, your rights are to:


  • Access to your personal data;
  • Obtain the rectification or erasure of personal data or the restriction of processing concerning the data subject;
  • Object to processing;
  • Lodge a complaint with the supervisory authority (Garante per la protezione dei dati personali).

11. Provision of personal data

The provision of your personal data is a requirement necessary to create a user account in the GAIR.

The lack of provision of your personal data implies the impossibility to create the user account, and the impossibility to load information in the GAIR.


12. Cookies

The Website uses “technical” cookies, such as navigation or session cookies, or tools to make functional and optimize the navigation and use of the Website.

There are also analytical cookies that collect aggregated information on the number of users and how they visit the Website. There are no profiling cookies.

Users may choose to enable or disable cookies by acting on their browser’s settings according to the instructions provided by the respective providers.
